Environmental Due Diligence Advisor

John J. McNally, P.A. has unparalleled experience in environmental due diligence. He is also well-versed in environmental risk management for corporate and real estate. John’s practice has focused on potential liability related to complex environmental contamination and compliance issues at major industrial, manufacturing, and government facilities.
John is a licensed professional engineer who served as an environmental engineering consultant for almost 10 years before transitioning to environmental law. His engineering experience primarily pertained to land development, water resources, environmental due diligence, contamination assessment and remediation, and hazardous waste compliance. As a result, John’s legal work has emphasized contamination assessment and remediation related to Superfund, RCRA requirements, storage tank regulations, and compliance and transactional audits.

John represents individual and multiple clients in complex, multi-party litigation or corporate/real estate transactions. He works closely in coordinating the environmental consultants involved in addressing the evaluation and resolution of environmental issues in the context of the financing, lease, purchase, and development of the real estate. He also addresses issues within lease purchase or sales transactions and other environmental problems associated with acquiring, developing, and operating commercial facilities and properties.

Career

Having practiced for 34 years as a professional engineer and lawyer, John strives to apply his skills and experience to identify and resolve environmental conditions and concerns in the most practical manner. He works closely with the parties and regulatory agencies involved to enable the transaction and business objective to be achieved.
Throughout his career as an engineer and lawyer, John has also been involved in evaluating and remediating environmental contamination at commercial, industrial, military, and aviation facilities on both large and small scales. He coordinates the response work and communication with the regulatory agencies to address these situations and has successfully assisted in the remediation and redevelopment of numerous commercial properties. These properties range from gas stations and dry cleaners/manufacturing facilities to major airports, Brownfields redevelopment projects, and Superfund sites throughout Florida and nationwide.

These matters include various contaminants, including petroleum, solvents, used oil, and hazardous wastes in accordance with local, state, and federal laws and regulations. In addition to contamination site evaluation and remediation, John has experience assessing wetland impacts and mitigation requirements related to property development and use. He utilizes the technical and legal skills and experiences gained over the years in these areas to achieve the most practical resolution and assistance to the client in reaching the project objective.
